When Work Begins

"Work commenced" means the point at which Caldwell CRM begins account setup, configuration, or onboarding for your business. This typically begins within 1–2 business days of your first payment.

First Month Payment

The first month's payment is required to initiate setup. It is fully refundable if you cancel before work has commenced. Once work has commenced, it is non-refundable.

Setup Fees

Setup fees are fully refundable if you cancel before onboarding begins. Once the onboarding process has commenced, all setup fees are non-refundable.

Monthly Subscriptions & Auto-Renewal

By enrolling, you authorize Caldwell CRM to automatically charge your payment method each month until you cancel. To cancel, written notice must be provided at least 30 days before your next billing date via email to caldwellcrm@gmail.com. Your service remains active through the end of the current billing period, and no further charges will apply after that. You may cancel using the same method through which you enrolled.

Annual Reminder

For ongoing subscriptions, Caldwell CRM will provide an annual reminder identifying your active plan, the frequency and amount of charges, and instructions on how to cancel.

Annual Plans (Growth & Premium)

Discounted annual pricing is available on the Growth and Premium plans only. By selecting an annual plan, you agree to a 12-month commitment billed monthly at the reduced rate, in exchange for the discount. If you cancel before the 12-month term ends, the discount no longer applies, and you agree to pay the difference between the discounted rate and the standard monthly rate for the months you have already used.

Example: On the Growth annual plan ($499/mo, a $100/mo discount off the $599 standard rate), if you cancel after 5 months you would repay the $100 monthly discount for those 5 months — a total of $500. You are never charged for the remaining months you did not use.

Caldwell CRM will provide a renewal reminder between 15 and 45 days before each annual renewal date. Payments already made are non-refundable.

Refunds After Work Begins

Once work has commenced, payments already made are non-refundable, and no partial refunds will be issued for unused portions of any billing period.

Outstanding Balances

Cancellation of a subscription does not waive or affect any outstanding balances owed to Caldwell CRM.

Usage-Based Charges

Any accrued usage-based charges (SMS, calls, email) at the time of cancellation remain due and payable.

Service Suspension or Termination by Caldwell CRM

Caldwell CRM reserves the right to suspend or terminate service for non-payment, abusive conduct, or violation of these terms. Where service is terminated for these reasons, fees already paid are non-refundable.

Your California Privacy Rights

If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA), as amended. We do not sell or share your personal information for monetary consideration or for cross-context behavioral advertising, so no opt-out of sale or sharing is necessary. You have the right to: (1) know what personal information we collect and how it is used; (2) request access to your personal information; (3) request correction of inaccurate information; (4) request deletion of your personal information; and (5) not be discriminated against for exercising any of these rights. We also honor recognized browser-based privacy signals, such as Global Privacy Control (GPC). 1. Services

Caldwell CRM provides managed customer relationship management (CRM) setup, automation, and related services for small businesses. The specific services included depend on the plan you select. We reserve the right to modify or improve our services over time.

2. Plans, Fees & Auto-Renewal

By enrolling in a plan, you agree to the setup fee and recurring monthly subscription fee for that plan. Subscriptions automatically renew each month until cancelled. By providing a payment method, you authorize recurring charges. Pricing and usage-based fees are disclosed before you enroll. We will provide an annual reminder of your active subscription, its cost, and how to cancel.

3. Cancellation & Refunds

Cancellation and refund terms are governed by our Cancellation & Refund Policy. You may cancel using the same method through which you enrolled, or by emailing caldwellcrm@gmail.com.

4. Client Responsibilities

You agree to provide accurate information, timely access to any accounts needed to deliver services, and to use the services in compliance with applicable laws. You are responsible for the content of messages and communications sent through systems we configure on your behalf, including compliance with anti-spam and telemarketing regulations.

5. Third-Party Platforms

Our services rely on third-party platforms (such as CRM, payment, and messaging providers). Their availability, pricing, and terms are outside our control, and we are not responsible for outages or changes made by these providers.

6. Limitation of Liability

Caldwell CRM provides services on a best-efforts basis. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for lost profits or revenue. Our total liability for any claim is limited to the amount you paid us in the preceding three months.

7. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated to active clients. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
